Terms of Service & Advertising Standards
Effective Date: October 2026 | Governing Law: Republic of India | Jurisdiction: Mumbai, Maharashtra
1. Scope of Marketplace Services
ABHIAD provides a transactional technology platform facilitating the discovery, reservation, payment, creative delivery, and execution tracking of Out-of-Home (OOH) and Digital Out-of-Home (DOOH) advertising inventory across India. ABHIAD operates as an intermediary marketplace connecting registered Advertisers (and their authorized media agencies) with verified Media Owners and Screen Concessionaires.
2. Inventory Reservation & Booking Holds
To eliminate double bookings, when an Advertiser selects available dates for a media asset, a transactional hold of up to 15 minutes is applied at the database level. During this lock window, the dates are exclusively reserved for the buyer. If payment verification via the integrated payment gateway (Razorpay) is not completed within this timeframe, the hold automatically expires and releases back to open availability.
3. Creative Artwork Submission & ASCI Compliance
Advertisers must submit high-resolution creative artwork according to the exact pixel/meter specifications specified for the asset at least three (3) business days prior to campaign commencement. All advertising copy must comply strictly with the Advertising Standards Council of India (ASCI) code, local municipal bylaws, and Indian statutory regulations. Content promoting tobacco, unauthorized lotteries, or defamatory material is strictly prohibited and subject to immediate rejection without refund.
4. Proof of Execution (PoE) & Verification Standards
Media Owners are legally required to mount the approved flex/vinyl or broadcast digital creatives on the designated start date. The Media Owner must upload geotagged, timestamped day and night photographs (and proof video links where applicable) to the ABHIAD platform within 24 hours of installation. Advertisers receive a 48-hour inspection period to review and sign off on the execution.
5. GST SAC 998361 & Invoicing
All advertising services are billed under Indian GST Service Accounting Code (SAC) 998361 (Selling of advertising space or time). Standard GST at 18% is levied on all transactions, structured as CGST (9%) + SGST (9%) for intra-state supplies within Maharashtra, or IGST (18%) for inter-state supplies across other Indian states and union territories. Formal B2B tax invoices with digital QR references are issued upon verified payment receipt.
6. Escrow Settlement & Media Owner Payouts
Client booking funds are retained in secure marketplace settlement escrow until satisfactory Proof of Execution is approved by the client or confirmed by automated platform inspection. Media Owners with verified KYC, valid PAN, and verified bank accounts receive net payouts (less standard marketplace commission) disbursed via NEFT/RTGS with unique bank transaction references (UTR).
7. Dispute Mediation & Jurisdiction
In the event of weather damage, power failures on digital screens, municipal notices, or mounting discrepancies, either party may lodge a formal dispute ticket within the booking portal. The ABHIAD super-administration desk investigates photographic evidence, server telemetry, and audit logs to issue binding resolutions or pro-rata credit adjustments. Any unresolved legal disputes shall be subject exclusively to the courts of Mumbai, India.
